Please read the following terms and conditions carefully, as this Terms of Use Agreement sets forth the standards of use between SBS Computer Consultancy (Pvt) Ltd(“SBSCC” or “we”) and you (the “Member”). If you do not agree to these terms and conditions, you may not use the Services and should not proceed to use the Services –, the Member agrees to these terms and conditions, including all amendments made to date. Again, if the Member does not agree to the terms and conditions of this agreement, you should immediately cease all usage of this material. We reserve the right, at any time, to modify, alter, or update the terms and conditions of this agreement without prior notice. Modifications shall become effective immediately upon being posted at sbsccimall.com/videos website. Your continued use of the Services after amendments are posted constitutes an acknowledgement and acceptance of the Agreement and its modifications. Except as provided in this paragraph, this Agreement may not be amended.
Description of Service
Subject to payment of the membership fee(s) and compliance with this Terms of Use Agreement, SBSCC is providing a single Member with a fully paid-up, royalty-free, non-exclusive, non-transferable, non-redistributable right and permission to personally (non-commercial) use the Services. The membership fee is not refundable at any time after the initial purchase.
Member may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell in any way any information, documents, graphics, software, products or services obtained from SBSCC’s Services or its website. The use of the Services on any other web site or networked computer environment is prohibited. Member recognizes that he/she may not reverse engineer, or reverse assemble the Services, SBSCC’s website . Member recognizes that unauthorized use of website content may subject said user to civil or criminal liability.
Disclaimer of Warranties.
The Services provided by SBSCC C on an “AS IS” and on an “AS AVAILABLE” basis. To the fullest extent permitted by applicable law, SBSCC makes no representations or warranties of any kind, express or implied, regarding the use or the results of the Services or its website in terms of its correctness, accuracy, reliability, or otherwise. SBSCC shall have no liability for the use of the Services or its website. Limitation of Liability
SBSCC SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER, AND IN PARTICULAR SBSCC SHALL NOT BE LIABLE FOR ANY SPECIAL, INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, OR DAMAGES FOR LOST PROFITS, LOSS OF REVENUE, OR LOSS OF USE, ARISING OUT OF OR RELATED TO THIS WEB SITE OR THE INFORMATION CONTAINED IN IT, WHETHER SUCH DAMAGES ARISE IN CONTRACT, NEGLIGENCE, TORT, UNDER STATUTE, IN EQUITY, AT LAW, OR OTHERWISE, EVEN IF SBSCC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Indemnification
Member agrees to indemnify and hold SBSCC, its parents, subsidiaries, affiliates, officers and employees, agents, and contractors harmless from any claim or demand, including reasonable attorneys’ fees and costs, made by any third party due to or arising out of Member’s use of the Services, the violation of this Agreement, or infringement by Member, or other user of the Services using Member’s computer, of any intellectual property or any other right of any person or entity.
Modifications and Interruption to Service
SBSCC reserves the right to modify or discontinue the Services with or without notice to the Member. SBSCC shall not be liable to Member or any third party should SBSCC exercise its right to modify or discontinue the Services. Member acknowledges and accepts that if Member uses its permission via the SBSCC website, that SBSCC does not guarantee continuous, uninterrupted or secure access to its website and operation of the website may be interfered with or adversely affected by numerous factors or circumstances outside of our control.
Third-Party Sites
Our website may include links to other sites on the Internet that are owned and operated by online merchants and other third parties. Member acknowledges that SBSCC is not responsible for the availability of, or the content located on or through, any third-party site and Member hereby releases SBSCC of any liability regarding such third party sites and their services. Member should contact the site administrator or webmaster for those third-party sites if Member has any concerns regarding such links or the content located on such sites. Member’s use of those third-party sites is subject to the terms of use and privacy policies of each site, and SBSCC is not responsible therein. We encourage all Members to review said privacy policies of third-parties’ sites.
Disclaimer Regarding Accuracy of Vendor Information
Product specifications and other information have either been provided by the Vendors or collected from publicly available sources. While SBSCC makes every effort to ensure that the information on this website is accurate, we can make no representations or warranties as to the accuracy or reliability of any information provided on the SBSCC website.
SBSCC makes no warranties or representations whatsoever with regard to any product provided or offered by any Vendor, and Member acknowledges that any reliance on representations and warranties provided by any Vendor shall be at your own risk.
Security
Further, if Member is accessing the Services via the SBSCC website, Member acknowledges that like any web application, the SBSCC website may be susceptible to hacker attacks and security breaches. It is the Member’s responsibility to ensure that the servers and computers using the Services are in a secure environment with appropriate firewalls, database encryption, virus protection, security patches including windows update in place. SBSCC is not liable for any loss of data or any other damages from security breaches, denial of service or other hacker attacks.
Governing Jurisdiction of Sri Lanka
The SBSCC website is operated and provided in Sri Lanka. The Services and any claim related to the website are subject to the laws of Sri Lanka, and such laws will govern this Terms of Use Agreement, without giving effect to any choice of law rules. We make no representation that our website or other services are appropriate, legal or available for use in other locations. Accordingly, if Member chooses to access our site you agree to do so subject to the internal laws of Sri Lanka.
Any action against SBSCC in connection with this Terms of Use Agreement and the Services must be brought within 12 months after the cause of action arises. In all events, we each waive trial by jury. In any proceeding to enforce the terms hereof, the prevailing party shall be entitled to recovery of an attorney fee, in addition to other costs of suit.
Compliance with Laws.
Member assumes all knowledge of applicable law and is responsible for compliance with any such laws. Member may not use the Services in any way that violates applicable state, federal, or international laws, regulations or other government requirements. Member further agrees not to transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national, or international law or regulation.
Copyright and Trademark Information
All content included or available on the SBSCC website or training material, including website and material design, text, graphics, interfaces, and the selection and arrangements thereof is © 2011 SBSCC, with all rights reserved, or is the property of SBS Computer Consultancy (Pvt) Ltd and/or third parties protected by intellectual property rights. Botnets
If member uses the website to access the Services, SBS Computer Consultancy (Pvt) Ltd retains the right, at our sole discretion, to terminate any Member accounts involved with botnets and related activities. If any hostnames are used as command and control points for botnets, SBS Computer Consultancy (Pvt) Ltd reserves the right to direct the involved hostnames to a honeypot, loopback address, logging facility, or any other destination at our discretion.
Fees
You are agreeing to our membership package service. Paid subscription will not automatically renew and you will not be charged again when your subscription expires. Subscription fees are non-refundable.
Other Terms
If any provision of this Terms of Use Agreement shall be unlawful, void or unenforceable for any reason, the other provisions (and any partially-enforceable provision) shall not be affected thereby and shall remain valid and enforceable to the maximum possible extent. Member agrees that this Terms of Use Agreement and any other agreements referenced herein may be assigned by SBSCC in our sole discretion. This Terms of Use Agreement shall apply in addition to, and shall not be superseded by, any other written agreement between us in relation to your participation as a Member. Member agrees that by accepting this Terms of Use Agreement, Member is consenting to the use and disclosure of their personally identifiable information and other practices described in our Privacy Policy Statement. No clause of this Terms of Use Agreement will be deemed waived, and no breach of this Terms of Use Agreement excused, unless the waiver or consent is in writing signed by the party granting such waiver or consent. Waiver of the breach of any provision of this Term of Use Agreement will not operate or be construed as a waiver of any other or subsequent breach. No failure or delay in exercising any right, remedy or power under this Terms of Use Agreement will operate as a waiver of any other right, remedy or power. The clauses if this Terms of Use Agreement which by their nature are to survive this agreement will survive its expiration or termination.
